AgriMax hired SkySpray, an independent contractor, to spray a highly toxic pesticide by airplane over AgriMax's orchard. The pesticide was effective only by aerial spraying, and even with careful flying it could drift if wind shifted suddenly. AgriMax and SkySpray posted signs stating, "Aerial pesticide spraying today. Stay out of marked fields." A sudden wind shift carried pesticide mist onto a neighboring organic farm, damaging the farm's herb crop.
During the same spraying run, Quinn ignored the warning signs, walked into the marked field to take photos of the plane, and inhaled pesticide mist. SkySpray used ordinary care. The organic farmer and Quinn sue AgriMax and SkySpray on strict-liability theories.
