Owner owned three adjacent parcels. Owner conveyed Parcel 1 "to City so long as the parcel is used as a public library." The deed said nothing else. Owner conveyed Parcel 2 "to Museum, but if alcohol is ever sold on the parcel, Owner may enter and terminate Museum's estate." Owner conveyed Parcel 3 "to Theater and its successors, but if Theater ever stops presenting live performances on the parcel, then to Arts Charity."
Ten years later, City closed the library and leased Parcel 1 to a private tutoring company. Museum rented Parcel 2 for a fund-raising dinner at which wine was sold. Theater stopped live performances and converted Parcel 3 to offices. Owner's heir immediately claimed Parcel 1 and Parcel 2. Arts Charity claimed Parcel 3.
