A bakery emailed a merchant mill: "Ship 1,000 pounds of organic flour at $1.20 per pound for delivery this week." The mill promptly emailed, "We will ship tomorrow." Before shipment, the bakery attempted to cancel, saying no contract existed because the mill had not yet delivered. In a second order, the bakery asked the mill to ship 500 pounds of rye flour. The mill shipped 500 pounds of wheat flour without explanation. In a third order, the bakery requested 400 pounds of cake flour, and the mill promptly shipped 400 pounds of pastry flour with a note stating, "Out of cake flour; sending pastry flour only as an accommodation."
Separately, the bakery and a merchant equipment seller exchanged emails agreeing that the seller would supply one commercial mixer, but left the exact delivery date to be arranged. Both parties acted for two weeks as though they had a deal.
